INFANT SURVIVOR OF ABORTION

Located on Saltspring Island, the hospital had a "therapeutic abortion committee" and it was to Dr. Hugh Borsman, on August 4, 1982 that Jody Cherry consulted to obtain her abortion.

The abortion attempt was unsuccessful and Elizabeth Cherry was born alive on January 20, 1983.

In 1990 it was reported in both the Vancouver Sun and the Province that a botched abortion and survival of the infant would mean a possible multi-million dollar settlement. Elizabeth Cherry survived an abortion attempt by Dr. Hugh Borsman. The award, according to legal experts, was a first as it was awarded to Elizabeth who was awarded rights as a human being "retroactively", since she survived the abortion attempt.

The award was appealed but in July, 1992 the BC Court of Appeal upheld the initial settlement, meaning Elizabeth Cherry was awarded $3.5 million dollars.
